I've heard a lot of people do this they say it's a lot better than going from Florida, but is it LEGAL?

Generally speaking, no.

There are a handful of ways to do this as a US citizen (though the Bush administration has tightened controls on these also) but going through Canada does not circumvent the existing ban.

(This does not mean to imply that you can't do it...only that it remains illegal.)

Fortunately, I hold out hope that with the demise of Fidel, America will return to it's senses and destroy Cuban Communism with it's real power...engagement. A Disneyworld Havana would have brought down the government years ago.

You just can't fly there from the USA; according to US law an American citizen cannot go there.
Best just to fly to Mexico, or Canada and then get on plane to Cuba. Its legal in Cuba for you to be there.
They will give you a tourist card, so your passport doesn't get stamped so you wont get in trouble once you are back. It's very strange that you guys cannot go to cuba!!

Yes you can. But why would you want to. This goes for any where else too.

Best way is by water.

Cuba is about 25 miles from Key West, Florida. Or you could go west from Puerto Rico, which by the way is a US Territory.

All you have to do, by going the water route, is to run through the gauntlet of the US Coast Guard and the Cuban Coast Guard. Technically, any way that people use to go to Cuba is illegal. But, if you are going to ask this question, why should you care if it is legal or not. That is if you are a US citizen. If you are not a US citizen, then any way that you travel is LEGAL for you. But regardless if you are a citizen or not, have fun with either of the 2 authorities. Spending time is a US or Cuban jail might wake you up and then again it might not.

It is not legal. All U.S. travel to Cuba must be licensed by the Department of Treasury’s Office of Foreign Asset Control (OFAC). Per the U.S. State Department, "This restriction includes tourist travel to Cuba from or through a third country such as Mexico or Canada". Although you could arrange such travel, you could face "civil penalties and criminal prosecution upon return to the United States".

Hi. Canada is not hostile to Cuba and you can get there from Canada. But now you need a Visa to get back from Canada.

Travel in itself is not illegal, but spending money in Cuba is - since it is an economic embargo. Thus the necessity to register with the department of treasury - they want to make sure you have a sponsor who will pay for everything for you whilst you are there.

yup. I'm Canadian and have friends who have gone to Cuba, and they run into Americans all the time doing that exact thing. It's not illegal. It's the US that severed ties with Cuba, but they can't bar you from going where you want.

I don't know about through Canada but you can go through Mexico. It's not legal for a US citizen but you can do it and they will not stamp your passport. There are many tours through Mexico.
