Yes it happens. There was even video footage of a guy urinating on someone's food. He was arrested. But you have to wonder how many times he did it before he got caught.

I have worked in restaurants for many years and no one I know of has ever really done that. Just don't be rude, cut them a little slack and you will be much more at ease.
