AMENDMENT #5 STATES:

WHAT WE THINK AMENDMENT #5 MEANS
An accused person has rights, such as: the right to remain silent; the right to know what you've done; the right not to be tried more than once; the right to not to have their property to be taken away from them, unless in debt to the government.
QUOTE
Prior to any questioning, the person must be warned that he has rights to remain silent, that any statement he does make may be used as evidence against him and that he has a right to the presence of an attorney, either retained or appointed.
Earl Warren, Chief Justice, US Supreme Court
WHAT WE THINK EARL WARREN'S QUOTE MEANS
Before a person can be questioned they must be notified of there rights such as the right to remain silent, and what crime they committed.
How much relevance does your amendment have today?
In the fifth amendment, it states many rights of an accused. A criminal is not required to testify against himself in a trial. A person must be told what crime he has committed before he can be put in jail. Double jeopardy, which means a person can't be tried for the same crime twice, is not allowed. The government must go through legal process before it has the right to take away an accused's belongings. The government must pay a person a fair amount before they take a person's property for public use.
The rights set forth in this amendment are relevant and argued daily. In a criminal trail, the lawyer fighting for the criminal will argue for the criminal's rights. He will make sure that the criminal will not incriminate himself. He will make sure that the criminal was told what he was arrested for before being thrown in jail. He will make sure that the criminal will not be tried more than once for the same crime. Also, if the government wanted to take anyone's property (including the criminal),they would have to pay a fair amount.
A current dispute about the fifth amendment is what rights do the terrorists have. Unless we are at war or in public danger, the terrorists have the right not to incriminate themselves in front of the jury, and they are not allowed to be held in jail without knowing what they are accused of. Therefore, the issue is this a war? The tailbone, not Afghanistan, decided to attack America. Are we at war with Afghanistan or terrorism? In my opinion we are not fighting Afghanistan. instead, we are fighting terrorists who live in Afghanistan. I believe that the terrorists are entitled to the protections of the fifth amendment, "the rights of the accused."
