Me and my wife are getting a divorce.We both went to court this monday for temp-custody.No one has custody of the kids,but my wife has a(court order)to pay child support because the kids live with me 5 nites a week- She pick them up from school and i pick them up from her parents house aruond 6pm and my wife have them on the weekends.Plus my wife left the home for a affair and she live with her parents .There was a routine for the kids the last past 7 months.Her check got garnished in feburary,The last week in feburary she took the kid and won't return them..She telling the courts since their no custody award to no one she don't have to pay child support and that why she took the kids out of the routine .The judge rule she the primary caretaker and i see the kid everyother weekend and i must pay child support.What are my options.

i will pray for you but, if you are a reall tru parent , fight it in court trust god and he will lead the way . tell the court why you want your kids back and why u think she has 2 pay child support . thats the only advice i can give you.

child custody fights can be horrible. Depending on what state you live in. If in TN i do know that custody atomatically goes to the parent who did not commit audultry. Which is why my daughters father has custody of his 2 other girls, and he doesn't even have them half the time or care about having them. In most cases the judge rules in favor of the mother unless she is demed unfit. and in a lot of cases she should be. No way around it you will need a lawyer. you didn't say how old the kids are either. In some state's a child at the age of 12 can say who they want to live with. You need to know the laws of the state you are in. Divorce and custody can be difficult besure to keep the kids out of it. And think really hard. even though you may not be happy with her is she a good mother. the judge is also going to look at who says the best things about the other person. Be very careful what you say and do

Not much. Unless a mother is ruled unfit due to child and/or drug/mental abuse, courts will usually award custody to the mother and dad get gets child support and state mandated visits. You can always petition the court for a remodification to child custody/ support hearing if you feel you have just cause for the safety and welfare for your kids. But for now youre stuck with the ruling although not fair, its still the courts ruling. Good luck

Sounds like she realized that she would rather not pay you so she took the kids, i doubt it's for the well-being for them, all you have to do is fight back, maybe have one week with her and one week with you, and then no child support should be exchanged. For a man to fight for his kids and give them the best stable environment is usually unheard of, but lately it seems like men are the ones getting custody, so I say fight for them, go to court again.

your options are to get a lawyer and fight for custody, or pay thechild support. either way, you should pay the child support you have been ordered to pay if you want to get your kids back. You might also get proof that you are the better parent if you have any. or that she is unfit to be raising kids.

Get a Good Lawyer via word-of-mouth, and never stop fighting for custody in a professional and civil manner, Your children will respect you for it and you will see them more often because of it.

Go back to court and get a court order that is more organized and specific.

go back to court and get custody. the way things are know she can take your kids out of state and there is nothing you can do.

go back and fight for your kids and asked for full custody tell them you had the kids and she stole them and you want them back because they have friend where you live and the mother is unstable because she left the kids and you need to do this as assp
