If you're trying to get out of an abusive household, and you tell one of the adults you're leaving, and they become upset and have a heart attack (becuase of either sadness or happiness, you know, general emotional ill health), whether they survive or not, is the other adult allowed to sue you for it?

1. They probably won't have a heart attack.

2. If you don't strike them, you aren't legally responsible.

3. Don't tell them, just go. If they are abusive, you should just leave.

No not at all. If you feel at risk in a house with adults and one of them has a heart attack because you are leaving well that is in no way your fault at all. If that adult has said that to you well that is emotional abuse as well to try to guilt you into staying in that unhealthy environment. Get out of there and talk to people who would never dream of hurting you physically or emotionally!! Good Luck to you!!!

Anybody can sue for anything they want. They can also get their lawsuit (1) tossed out of court; (2) be countersued; (3) be assessed attorney fees and court fines for filing a frivolous lawsuit.

In your case, the matter would be (1) tossed out of court by demurrer to the complaint for failure to state a cause of action for negligence.

The only exception I can think of is if you knew about a heart condition and it can be shown it was intentional. As a different example, if you knew somebody had a heart condition and you hid in their closet and put on a scary mask, and when they opened the door you jumped out at them, and they dropped dead on the spot. There you have intent, and besides the civil action there would be criminal charges.

Unless you've got proof that the heart attack came on as the results of the abusive words. I don't think even doctors are able to zoom into it. Heart attack does not derived from hearing sad or abusive words. It's an onbuild within one's body.

No, definitely not. Sounds like there's some emotional blackmail going on. If a person wants to leave, then it is that person's choice. How other people in the house deal with it is THEIR choice.

You certainly can't be sued just because you want to leave and someone becomes ill.

Yet another good reason to get out of that house!

Heart attacks are not caused by sadness - they are caused by serious clogged arteries from years of bad food, etc.

Nobody's going to sue anyone - they're just talking.

Let them talk while you walk out that door and keep going.

you can sue or be sued for almost anything.
but the case probably wouldn't last before a Judge so don't worry.

besides your leaving didn't cause the pre-existing condition,
it was only a stress trigger. you didn't give his poor health to him. it was exacerbated by THEIR REACTION brought about by an external situation, in which you could not predict the outcome, since you have no medical training.

Not at all!! You have no control over the person's health, you didn't TELL them to have a heart attack. And even if they tried nothing would happen especially if you are being abused. Please tell someone about your problem or get out of that sistuation. Go to freind or family member if you can. It breaks my heart to hear about abuse!! Please get help! I hope everything turns out well for you

Criminally, it is all about intent. Was it your intention to cause the HA by saying something grievously shocking, AND did you know the medical condition and ignored warnings that HA was immanent. In other words, it is the yelling of fire in a theater situation. This would be very hard to prove.

No. Informing someone of a situation is different than intentionally trying to cause physical injury.

Truth is always best when it's spoken with care.
