My husband left me with no money and three kids and now all I know is what state he is in. No other info on his exact location but I need to file for divorce, can it be done for free and can it be done eventhough I dont know where he is? Some one please help!!

thats abandonment.... and today, its a federal offense to run across state lines to avoid child support. since you didnt say anything about child support, i am guessing you dont have a court order for it yet.

you need to handle the child support first, the divorce can come later.

CHILD SUPPORT
1) call your county court clerk or court house and ask them where to file for child support. its easy, they will tell you exactly what you need to do, and walk you through it.

todays child support is based upon BOTH parents incomes, so do the "hunting" for him to help them find him. if you have old tax returns, bring them for an idea of what he is capable of making.

2) you can apply for welfare and the state will hunt him down worse then the IRS. they will also do all of the paperwork for the child support court order; they will let you know what you need to do/when.

3) if you know the state, do some searches to find him (websites listed below)

4) do background checks on him, most of the time, current addresses come up on them some times, so you may just hit paydirt. do them with different companies. they run about $30.

5) if at any time your child support caseworker (or dept) isnt on the ball, pull rank on 'em.

call your caseworker and ask:
--where you apply for interest on the arrears?
--was the case submitted for tax refund intercept?
--was the arrears reported to the credit reporting agencies yet?

---sit down and write a letter. in it, give your contact info, case number, his info, arrears amount, him quitting his job (with such a huge arrears amount) and ask them what they are doing about it.

then take that ONE letter and FAX it to the following:
a) your states Attorney General (link is below)
b) your states Governor (link is below)
c) your states Regional FEDERAL Child Support Office (link is below)

phone calls are useless; they are ignored, denied and forgotten. mail ends up on someones "to do" pile, but FAXES are effective. its proof you sent it and proof they recieved it, therefor, they HAVE to address it. if you cant find a fax number (most are listed online) then just call them and ask for it.

if you hear nothing in a week, fax them again. fax them weekly if need be. its the squeaky wheel that gets the oil, if ya know what i mean.

DIVORCE:
you can file divorce on abandonment, Legal Aid in your area may be able to help. I believe he has to be served though. divorce laws are at these sites also.

Go to the family court and file for a divorce. File for Abandonment. They will post an ad in the newspaper and if he doesn't respond within 60 days (check your state for the time frame) your divorce will be granted. Then, go through a child support enforcement agency and inform them what state he resides in and they will work on locating him( I hope you have his Social Security Number). If you don't have a child support case, they can open up a case for you. If you have a case, then they can pursue enforcement actions. This is the cheapest route that i am aware of. You don't need an Attorney for this way.

File for what is called a "missing spouse" divorce on the grounds of abandonment. You can contact your local legal aid assoc for help (yellow pages). Basicall due to the due process process of the law, every attempt will be made to contact her husband of the pending law suit against him. It will also be posted in the newspaper for a short time stating the court date and time. Court date will come and go on without him awarding you your divorce and everything you want. The only problem being to collect child and spousal support without knowing where he is. Good luck

You will have to save the money up and file for divorce on the grounds of abandonment. see if your family can help you out at all with this. yes you can sure file if you have no idea where he is. Contact a lawyer or a paralegal and find out what your options are .... You may even be able to go through legal aide. Good luck to you. Legal aide will help you and walk you through things and hopefully someday they will be able to track him down for child support for your kids. If you know his social security number and date of birth this may be of help as well in divorcing him and even possibly tracking him down through it. There are ways of them locating him trust me lol.

Look up "legal aid" in your state. Check with the county court if you're not sure where to find legal aid for divorce in your state. If you meet their guidelines, you may be able to get it done for free. As long as you know his ssn #, they'll track him down. (If he's working and using it.) Even if you couldn't find him, you can still divorce him. He's given so many days to respond, and it has to be run in the papers, so if you know the state he's in, that's better than nothing. do a search on Yahoo "(your state) Divorce" This should get you some websites about divorcing in your state, how to get divorced when hubby left the state, and were to get free legal advice. Good luck

After your divorce is finalized, through a Legal Aid group, you can ask a judge to grant you child support. If he says yes (which he probably will), he can also issue a warrant for your husband's arrest (which will make him easier to find).

It will vary depending on which state you reside.

In CA you can request a fee waiver if you can show that it would be a financial burden to pay.

You can also go down to legal aid, or your counties equivalent, and get low/no cost legal advice.

i think if you contact legal aid they will help you and maybe help locate your husband but i think you could get a divorce anyway with out him signing

it can be done for very cheap thru the county law office. Mine was done for around $350
