Where would the children live? We have relatives that would no doubt raise them, but would they be put in a foster home temporarily?

I wanted to know if there was the possibility of them going to foster care temporarily -- even if we had a will. My husband and I will do it ASAP. Thanks All!

CPS (or whatever it is called in your state) will always attempt to place children in a relatives care before placing them in foster care. Their goal would be to find a relative that would take all three children in. If that's not possible, then they would most likely split the children up, but still keep them with family members.

As a last resort, your children would be placed in foster care.

As others have posted, having something in writing (whether through a living will or a "regular" will) would be much better, because then the majority of the burden would be removed from CPS because you've already made the choice as to where you would like your children to go.

You create a living wil so you don't have to worry about this. The state would lean towards giving your children to a relative, providing they are fit. But again, wouldn't you like to specify what relative it is, and leave them what ever assets you have so that they may raise your children. Again, living will.

You have kids, but you have no plan in place in case of emergency?
You should have a will drawn up stating who the children would go to in the event of your death, as well as an emergency plan for the interim period.
We have an emergency contact in both our cell phones and in our wallets that would immediately contact our brother and sister-in-law and our adult daughter, who have Durable Power of Attorney over our children in the even that we are not able to care for them or are ready to be 6 feet under.

You actually have the power to control that, but you and your husband need a will that states exactly what will happen to the children.

See a lawyer and get a will now! Before it's needed.

Why do you ask a question like this? Why don't you have a will filled out stating who you want to raise your kids?
