I have 1 child. I live in IL. The rule of thumb is 20% child support for 1 child. My ex is a loser. But not enough of a loser to lose custody, just a borderline loser. She spends no money on my child, when asked where the money goes I get the usual B.S. Housing, electricity, etc.. My ex has nothing. Rents a house, cell phone shut down all the time, car company calling about payments. Where is my money going?
But step Dad loves to buy his Boats/Campers/new guns, hunting season & fishing season R big alone time trips for him too. I spend $ on my child when she is with me, vacations, clothes, museums etc..alot of $$$$$$$$
So my question is-- 20%?
and now she wants an increase to my new pay scale. Which will hurt me, and my child, as I wont be able to give anymore.
I do have a step-child in my house that I do not get any Child Support on. Father is MIA.
So will that be a factor in court, or is it :
"20% is 20% and get out of my courtroom. Thank you your Honor......

Wow is Yvette a fountain of information. A little bitter too. Yvette, without spelling out what type of loser my ex is in detail, I thought loser would be just enough.
She does nothing! I take her to the dentist, every other week I have her from Fri Nite Sat-Sunday and guess what...She is in religion classes on my weekends, for 2 hours.
Now I dont want to play into your bitter tirade of information, but I also have rights.
Why on my time, my special time, my short time, am I running her to Religion classes, dentist and doctors, cutting her toe nails, and when we do have a minute to finally spend time together, she falls asleep cuz her mother runs her like a basket case!
So you can take your "woe is the mother life with the children" stories to someone that agree's....maybe my ex-wife, or the unfortunate women who's men duck out and dont pay support.
That was a heck of an answer, for someone that must be so bitter against men, but ot good fathers.
Peace,

any changes can warrant a new hearing to review the child support and income. also, the law is that every 2-4 years (depending upon the state) there is a cost of living increase for child support, automatic.
both parents incomes are calculated today, thus, a lower amount ordered, and BOTH parents contribute to the support of the child(ren).
whats it spend on? are you kidding? living expenses, thats what its for...support (NOT Child Trust Fund).
you pay what? 400? 600? 900? (WOW)
ok, lets see...
rent; 1000
electric 300-500
food 400-600
diapers 75-150 per month (fluctuates when baby is sick or teething)
heat 300
phone/cable 100
auto; (for doctors, dentists, take to school when they miss the bus, pick up when sick, pick up medicines, get food) 200
clothing/shoes/boots 200-400 every 2 to 3 months (seasonal and they grow)
that doesnt even include dental, doctors, glasses, daycare, hair cuts, school supplies, school lunches, school projects, class trips, class pictures, over the counter medicines, prescriptions, laundry det, dish det, cleaners, soap, shampoo, toothpaste, acne medicines, bras, pads, christmas, easter, halloween, tooth fairy, birthdays, etc. and sooo much more.
CHILD SUPPORT DOESNT EVEN COVER FOOD / SCHOOL COSTS PER MONTH.

I've worked as a legal assistant in family for over 15 years and have never heard of a 20% rule. Child support is a formula that is based on income, time spent with the child, other children in the home, etc. Perhaps you should consult an attorney and find out what your child support guidelines say.

The Step dad's income should be taken into consideration too. It is in my state. As long as your child knows that you love them, and you are good to them, the child support should not be an issue to them unless your ex tells them differently. I was on the other end.. no support received, but he and the new wife had new cars... boat, motorcycles.. but too poor to help support the kids he already had. I feel bad for you fathers who do the responsible thing and get the shaft, and the others seem to just slip through... even the courts.

You would not be entitled to child support for your step child. You new wife need to go to court and 20% from the child's father.
20% is rough but that seems to be the standard rate. Just suck it up and do what you got to do.
The family court system don't really care about fathers

I like this "She spends no money on my child," Does your child live under the same roof she does? Does your child benefit from the utilities that your ex wife pays for? Does your child eat the food that your ex wife puts on the table? Does your child wear clothes to school? Does your child wear shoes? THAT is what the child support is for. To pay for the things your ex wife provides to your child on a daily basis. So she as well as the step father IS spending money on the child.

I know here in Texas, it is that way.....the step-child was not a factor in determining how much you paud before and will thereby not be a factor now, as unfortunate as that is. Your ex is entitled to use the support to her discretion, and does not have to prove anything. Unless you can prove that she is starving your child, neglecting medical care, etc, there really isn't much you can do. Don't tell her when you get a raise, and don't tell your daughter either.

Yvette is just your typical man hater. She must have laid up and punched out a few kids with some loser so she must figure all men are trash when in reality the only thing trashy was her judgment! You will be lucky if you only have to pay 20% be glad if that's all you have to pay they normally bleed you dry!

You and your child are falling through the cracks in the system. She WILL get the support increase. If her and her new husband are not neglecting your child you will have to wait until your child is old enough to choose where he wants to live. BTW never miss a payment and ALWAYS visit.

I am in Illinois too. Yes, she can take you back to court for an increase.and if you stay at the same job and get increases yearly, she can keep taking you back every 36 months, until your child is 18.
If you want to pay less, you need to make less money. Unfortunalty that is the way it is.
