Lets say the father is around but doesn't contribute in any way? What would be the exception to this(name change)

Sure, you'd have to claim they were fathered by a man whom you don't know. This way they can lose their real father's last name. Along with any money he's paying for them.

You can petition the court for a name change, say for instance, if you wanted their last names to be the same as yours. You are required to post public notices for 3 or 4 weekd (i.e. - newspaper "legal notice), but the Clerk of court generally takes care of that after you file your petition.

She would have to have full legal custody, I believe, which is not the same thing as having a deadbeat dad.
