MY MOYHER HAS A FRIEND ABOUT 77 YRS. OF AGE. SHE LOST HER HUSBAND JULY 2006.
HER SON IS TRYING TO CONTROL ALL OF HER ASSETS THROUGH A LAWYER. HE HAS GOTTEN AWAY WITH SOME OF IT. IN SO MANY WORDS..... HE HAS IT AS IF SHE CAN'T MAKE ANY DECISIONS FOR HERSELF OR ANYTHING, WHEN IN FACT SHE CAN. WHAT SHOULD SHE DO?

Your mother's friend should get herself a lawyer and get an exam to prove that she is mentally fit to make her own decisions and get her son the heck out of her life fast before he tries to have her declared incompetent and committed. People will do anything for money even hurt their parents. Who knows, he may even drug her to make her look mentally unfit and have her put away. Not much she can do about it then. Doesn't she have any other relatives that can step in and help her out?

Get her own lawyer and inform him of her son's lawyer. She can, assuming she's TRULY of sound mind, make her own decisions. A Will would be a good thing for her to make if she hasn't already. The law will stand by a Will no matter if her son has 70 lawyers. But until her death, her lawyer will do the fighting for her.

She needs to file a "Power of Attorney" to someone she trusts. This will take away any rights her son may have to make these kinds of decions without her knowledge or say so.. This person needs to be someone she would trust 100% to make the proper legal decisions for her. A lawyer will tell you the same thing BUT a lawyer is NOT needed to do this as she can do this on her own. But i do suggest getting a lawyer to assist as there are other issues which she may not be made aware of.

she should call her local Council on Aging and tell them what is happening, they can recommend a good attorney and maybe offer some other assistance in the meantime to help.

also have her call her local Senior Center; maybe there is a retired lawyer available that loves to offer free legal advice. they also might be able to offer her other assistance as well.

regardless, the bigger the fan base (the more people she is in touch with) the more to stand up in court and say she is perfectly capable of making her own decisions.

She needs an Attorney, Will ,LivivngTrust, etc. Depends of her assests, medical records, Power of Attorney can be challenged. I pray her son is not taking all her money and have her on the streets and she does not even know. The son must be the only child. Nothing wrong with your mother having a friend whatever age she choose. Do not control her life it she is not being taken advantage of and should have someone that cares for her, like you and not grow old alone. My mother and her son is misleading--- God help your mother after having children that do not have her best interest at heart. Do not try to put her away--God knows everything--The fear of God guide us.

She should tell her son to stay out of her business. He cannot take anything if she tells him no, assuming she still has her wits about her. I would put a stop to that right away.

Tell her to make out a will for herself, if she has not done it already, and call this lawyer, and tell him/her that his/her services are no longer needed for her stuff.

Pokey is right. Too many people think the elderly are incapable of dealing with things themselves, and it sounds like it's time for a lawyer to step in and have this stopped.

If your mother's friend is deemed incapable of making a desicion by a professional, than her son can do it only if he has power of attorney. If however the woman is fit and mentally sound the son cannot. However if when his father died he left all of his assets to his son, then he may be taking the assets belonging to his mother, presuming they belonged to his father. If you can find a copy of the man's will I suggest you see whether there is any sound reason for what the ungrateful son is doing.

Get a lawyer! If she's still sane/coherent and can prove it, she could get the court to revolt her son holding of her assets. She would have to go through a lot of testing, interrogatories, and lots more but that's the only way to get her assets back.

Find a lawyer who deals in elder abuse (sometimes under the category of Family Law). Immediately.
