Yes, oddly even with all the security implemented in the world. The DoD and DHS policies reopened the access of both your audio transmissions and data transfers. Remember the encryptions are only effective while the data is on the remote servers. But much like a guy with a scanner doe, when you actually access the data to be retrieved it can both be mirrored and/or recorded during actual transfer.
If you are finding that your data is being accessed while you are not using it, then guess what...Someone you know, knows your account access codes and has been accessing it without your permission.

Yes if you are using Cingular like I am I have found a big flaw in their system. They do not have enough security on their site to prevent other people from getting into your account and changing the password on your cell phone. This alos allows someone to see who call when you call as well any text messaging that you do. Not sure about other carriers but I know this about Cingular.

cell phone carriers identify you through caller id, that's how they know that it's you and they let you hear the messages. if someone calls your carriers voice mail number through a spoof calling card (a calling card that lets the caller spoof the id on the receiving end) they can enter your cell phone number to appear on the caller id, thus fooling the system to think that you're calling that way he can listen to your messages. your best bet is to put a password on your voice mail account that you would have to enter even when calling from your own number. (if your carrier supports that).
