I just rented a home not knowing tha the owners were going into forclosure. I am told I have one day to leave even through I had a contract with the homeowner for a year. I have also paid the rent for the month.

You'll most likely have to move. You paid the owners and not the bank, so the bank won't want you in the house. They are trying to sell the house, and it makes it all that much more difficult for them to sell it if someone is still living in it. You could call the mortgage company to ask for leniency for your case, but I doubt you'll get any.

You'll need to file a small claims court claim against the owner to get any money back. Gather all of your bank and rent payment records together for court. You'll need to prove in court what you've actually paid towards rent. If you paid a deposit, I'd ask for the deposit back in court. Also, any moving costs that you can document such as getting a rental truck to move, etc I'd bring all of that documentation with you also showing that you had to pay costs to unnecessarily move when you had a one year contract. You can try getting the moving costs back, but you may or may not get reimbursed for that. Make sure to bring the rental contract with you to court and read it over thoroughly before you get to court so you don't have any surprises or see any loopholes for the owner.

For court, you need to be well documented if you want to win the case. And I'd file the claim very quickly. If the house is being foreclosed on, the owner may be also claiming bankruptcy. If they claim bankruptcy before you can get your money out of them, they may have just swindled you out of that rent money.

You poor thing. Regretably you have no recouse other than small claims court to get your rent money back. I have rental properties and if they ever went into foreclosure the bank does not care who is in the house and even less when it is not the home owner. The bank wants you out they own the house now. You really have no course of action.

Get a lawyer NOW. He can get your rent back. Beg the new owners to stay. Look up "Squatters rights". In most states it's illegal to kick people out in winter. Call the local newspaper and make a stink out of it.

Talk to the bank holding the mortgage. I'm sure they would be happy to keep you on until the house is sold. Otherwise, stand in line with the rest of the creditors.
