My scooter will run but only go about 10-15, its capability is about 35 but it wont really reach it, maybe sometimes? what seems to be the problem? (there is no choke either)

Before removing the carb for internal jet passage inspection, might be worthwhile to remove the valve cover and check the valve lash . . manual download:

Those Chinese scooters frequently have fuel delivery and valve tightening issues. Start by giving it a tune up, that will probably cure your problem. You can find help and answers to any other scooter questions in the forum at www.scootdawg.com

2 stroke engine?
--Clogged muffler - needs to be replaced
--Top end worn out - needs piston & rings, maybe new cylinder.
--Dirty air cleaner.
--Check the air cleaner first.
--Ride the bike without the exhaust (it's gonna be loud as hell and don't run for more then 30 seconds). If it's a 4 stroke, don't bother with the clogged muffler test.
--While the exhaust is off, look into the exhaust port with a flash light and mirror. Any discoloration below the rings and/or scoring of the piston/cylinder wall and the top end will need to be rebuilt.

Chinese bikes and scooters are notoriously cr@p. It could just be you bought a lemon. Not much you can do about it apart from learn your lesson, sell it for what you can and buy a proper scooter/bike for proper money. you get what you pay for.
