My partner's father is an overzealous church deacon. His father lost a considerable amount of money at stocks, built an enormous, fund-draining home, and claims he now needs the land sale money to keep the house but he consistantly throws away $400+ a week to a small country church in the form of a "donation". The son is furious at his father for secretively selling off portions of the family land to pay for trying to live too big and appear to be the "big man" in the county at church. The land has been in their family for several generations, and has always been kept intact, until recently. It is also suspected the father is trying to sell off land to make a very large donation for a proposed annex for the church. The son cares deeply for the land, and sees the land as a part of the family legacy, not as a commodity to dice and sell. Can the son do anything legally to prevent the further squandering of the inheritence?

If it is in the fathers name, I do not think so. Try talking to a Lawyer.

No. The land belongs to the father. There are no legal steps Son can take to prevent his father from selling his own property merely because Son wants to someday inherit it. And Dad has the right to spend his money however he wants to.

I understand that the land has been in the family for generations, but that doesn’t change the answer.

However, the son can offer to purchase the property from Dad

I assume this is in the USA, basically under us law the children once past the age of 18 have no legal right to any inheritance from the parents, so he would not have standing

You can try and look at the wills over time which past the Land from generation to generation to see in any of the wills the land was given with conditions attached IE the Land could not be sold, etc

It appears the son hasn't inherited the land yet. Hence, the owner of the land can do what he wants with it, assuming the father is of sound mind.

You can fight anything legally, you just have the burden of proof or wrong doing. And the lawyers are the only ones that truly win.
