I live in upstate New York and all I have heard is that I have to be fired to collect. I work in a pretty hostile enviroment right now, the owners are getting divorced, I was just passed over for a raise and the new girl got salary, about 20k more. This is a restaurant, banquet house that opened last June, and I have been here since July. I have worked my butt off, wearing many hats and have quite a few people who will vouch for all the work I have done for this place. What can I do? I hurt so bad for being used one more time. I am the office administrator and incharge of personnel and payroll. I signed a confidentiallity agreement. Is that going to mess me up?

If you voluntarily leave a job, you more than likely will not be qualified for unemployment compensation. There are specific reasons for which you can leave a position and still get the unemployment compensation and you can get those on-line from the Office for Unemployment.

You are probably better off looking for another position. You should be able to find someting fairly quickly in NYC, HR/personnel is usually not a position affected by market influences, except mergers.

If you quit, you would probably not be eligible for unemployment comp unless your reason for quitting was judged as acceptable, and you wouldn't know that until you had already quit and applied for unemp comp.

If you're laid off, then you'd be eligible.

If you're fired for cause, then you're generally not eligible - states differ as to what is considered "cause", and also for what are acceptable reasons for quitting.

The confidentiality agreement shouldn't have any affect on your eligibility.

Sounds like you need to start looking for a new job. Good luck.

Been there, done that. To get unemployment insurance you must have worked for a specified length of time and have been let go *without* cause. That includes fired without cause and being laid-off.

I had a boss that was physically, mentally and verbally abusing me for about 16 years, at the University of Maryland. He also took full credit for everything I did, and blamed me for all his screw-ups. I finally had to quit.

In order to qualify for unemployment, you have to be terminated by the company for some other reason than "cause" (in other words, you can't be "fired" and still qualify.) If they laid you off, for instance, you would qualify for unemployment.

And you never qualify if you leave voluntarily. Period. Sorry; you're going to have to find something else first.
