No draft in the immediate future. Ditto WWIII

if there was a major theater war like WW 2 again there would be a draft.

There will not be a draft in the near future.

The Courts would say the constitution gives government the power to have conscription in article 2 giving congress the power to "Raise an Army". I agree that the Constitution does not give the government the power to have a draft (you can raise an Army the same way companies higher workers by increasing pay and benefits) but it also does not give the government the right to have welfare, unemployment, social Security, food stamps, licensing of professionals, have a department of education, HUD, USAID, or most any other government program you can think of.

The Constitution limits Government's powers, it does not limit individual rights.

The draft was never repealed it was just not used becaue of the all volunteer military. Selective Service still exists, has offices in D.C. and that is why people have to register for the military draft still. You would think that you would know that since you researched this enough to make a mistake about the constitution. It is likely that since you did not know that people still have to register and if they don't they cannot qualify for student loans and grants you probably do not live in the US. This is just a political scare tactic invented by a Michigan Congressmen to try to get young people worked up and fear that they might be asked to serve their country. It is meant to scare cowards into voting one way or another. Worked didn't it?

Please provide us with your link to where it is against the Constitution?. If WWIII broke out, yes I would assume a draft would be reinstated, but for now the volunteer army is the best way to go. Remember, a Dem Chuck Rangle from NY wanted to re-instate the draft, and ended up voted against his own proposal. Any re-instate the draft comments are just polically driven.

Where in the US Constitution does it say that
that it can't hold a draft?

We've certainly done it in the past (Vietnam,
World War II).

Indeed, the Constitution specifically mentions
the ability of the Congress et. al to form a
military and that only it can declare war.

As for World War III, if we ever get involved in
a nuclear war, the draft will be the least of our
problems.

I just wonder if the problems in the Middle east
have the potential to go nuclear...

There is not such thing in the US Constitution saying you can't be drafted. Look at your history draft Vietnam War, draft Korean War, draft World War 11, draft World War 1, and anyother time the US armed forces wanted to or needed men for the military you don't know what the hell your talking about. It's your duty to serve your country or are you one of those damn draft dodgers that should be put in prison.

Are you sure the constitution forbids a draft? That would not make sense in light of the drafts of the past.

Its in the constitution? Hmmm...didn't know that...which amendment? I could be 100% wrong, but I don't think there is a constitutional amendment outlawing the draft.
