can circuitcity sell you an open box product?

upon buying an 850 dollar computer from circuitcity, i thought it was brand new. i thought maby just maby there was a 20 percecnt chance some 1 used this b/c the foil (protection) in which the tower was protected was slightly damaged. from day 1 i had problems with a1720n pc from cc. constant restarts i only installed spyware removal programs and it would restart when ever i loaded anyting. (watch videos, play games, or load any apps or create new user acc for windows) i returned it a week later i yelled at the ppl they were very kind and gave me an exchange new pc w/o charge. i brong it back home and holy cow. when i opened it up i realize those bastard gave me an open box pc when i bought full price for a new one. this 2nd one they gave me was totaly diffrent

1. the boxing was diffrent the 1st one was damage
2. the dvd drive opened the 1st one didn't
3. towers on this new one had expansions
4. there was a setup when i started b4 there was none.

can cc do that? sell u a openb

open-box. can they do that? i mean mabe they thought boy we can scam this kid cause he seems stupid minority with his dad. he knows nothing about computers. and hes so shy i bet he wont bring it back for a refund if he knew it was broken. i might make a complaint b/c of this. i payed for a NEW computer not an open box computer with problems. this 1 seems to be running fine. also if there is any experienced pc users i also bought a system backup with this when i got the 1st. well it work with this pc ? it's exact same brand/model exept this 1 is new and the other one was open box (which i had no clue it was open-box) and do u think i can return it? it's on a blank dvd that says 1 of 1 and 2 of 2 i dont think it's any use and i dont know if it works since i got a new 1 but same mode/brand

o sorry for my spelling gramar. if anyone is confused:

1. i bought a computer thinking it was new.
2. after returning it due to problems/crashes they gave me an exchange for a new 1 ( i asked)
3. after opening this 2nd one i realized this 1 works better and is new and the 1st one they gave me was open-box and deffective/not working properly.

I would report the incident at least. Since they have remedied your problem there is no cause of action, but other consumers should be advised of this practice so that they will be aware that it has happened.
