Although your neighbor might have a pool, you'll have to think, who had the fence put up originally and who's property its on, Don't use the pool as an excuse to make your neighbor try to pay for 1/2 of it. Heck if it's on their property they should pay for it all and if on your's you should.

Depends on whos fence it is.. is it yours or thiers? ("generally" the easy way to tell whos it is is the framing & posts will be facing inward to who the fence actually belongs to) The pool fence requirements dont really have much to do with this as its a between yard fence but they may have to fence thier pool if the fence is yours and you decide to take it down altogether.. Some neighbours will split common fence line costs.. but thats not mandatory

Last I knew, anyone who owned a pool, by law had to fence it in, regardless of whether you have a fence or not. You could take your fence down completely, and they would still, by law have to fence in their pool. It is kind of you to be willing to share the cost since you are not legally responsible. If you want to double check, just call your homeowner's insurance co. Unless there's something in your deed that specifies otherwise?

I believe most places require that if you have a pool, you must have a secure fence around the area. In that case, it should be his responsibility to keep it secure. So, I would think that he should be responsible for at least part of the cost. You might want to check the laws in your area.

While the pool owner is responsible for the pool any part of the fence that you share you will be up for part of that cost.

Every area that I know of has there own law and that law requires a pool owner to fence his/her own pool for their own protection, the insurance company would agree I'm sure. This would go along with any code requirements for the area.
They would have to follow with gates, locks and or hinges, the whole shooting match. When you get a pool you get the whole deal.

Depends were you live. In IL it is up to the towns to in force rules like fences and pools. But I think the cost would be to whose ever property it was on.

he is responsible to provide a safe fence around his pool for the sake of safety...but any fence repairs between yards is voluntary for both parties....

I think you would have to prove that the existing fence is not doing it's job and then he would be liable to cover half the cost, but if the existing fence is still doing it's job then you won't be able to get him to pay.
