Does she have a model/subject release? If not, I would contact MySpace and insist that they take it down immediately and tell them that, without a signed and witnessed release, she has no legal right to display it. That may or may not be accurate, depending on how the photo is used, but there's a good chance it *is* correct and probably a decent chance they'll act on it even if it's not.

Despite some clueless earlier answers, you *do* have some legal control over how your photos are used. If it's classified as an editorial usage, then you might be out of luck, but you might as well proceed as if it is a situation where a release would be required.

Yes. She can as long as she's not showing a naked picture, but even then if she did that her account would be deleted by MySpace. You can't claim slander either unless she is sharing information with the public that was personal and private between the two of you when you were married. Invasion of privacy can only be if she's sharing your SSN with the public or something to that effect...

In my humble opinion, I believe that some women do NOT deserve ovaries. Some of the $hit they pull makes it harder and harder for chicks like me to find a good man that isn't battle hardened and full of distrust. Good luck. :)

What kind of photo of you? If it shows you in some embarassing or compromising situation, I guess you can claim that it's defamation to your character/invasion of your privacy to get her to take the pic off. Or, if you really don't want your pic to be on Myspace perhaps you could contact them and tell them to take that picture down.

yes she can....if she is bashing you in some kind of way you can complain and they MIGHT do something but if its just there you have to put up with it
