Not necessarily. There are a number of factors that can make that an incorrect statement, including implied and actual waivers.

It is a truism that one does not assume a risk that is less than that normally associated with that activity. You may be correct to assume a risk that is greater with any changes in the level of that activity. The old CYA. ( covering your ***).
