could someone tell me why its not possible to have an accident anymore.. An error of judgment instigates a compensation claim, an hospital doctor makes a wrong decision, the patience with a solicitor at the ready calls it neglgence, get me as much money as you can. is'nt it about time that when these Vultures called solicitors were made to pay costs when they lose their vexacious claims. At the end of the day Doctors don't go out of their way to make mistakes. If you clear snow from your front door, and somebody falls over and scratches their leg, in comes a compensation claim, if you don't clear the snow and someone falls over and breaks their neck, then thats allright, your in the clear.... what a cranky world we live in...

yes i agree, but in order to stop this type of thing, you need to get rid of every bad person in society, i heard of a guy who had these cigars, very old and rare, insured for 200000 dollars, he smoked them and went to court and sued the insurance company and won, for fire damages, right after that, they arrested him for arson for profit.

The basic theory behind the tort system is that the damage should be paid for by the negligent actor rather than an innocent victim. Negligence or a breach of the standard of care is required. If there is no negligence there is no claim. If a claim is truly frivolous, the plaintiff loses in court. The ability to file a claim that may lose is a cost of having a system that protects individual rights. The other side of the coin is that insurance companies and their lawyers mount frivolous defenses to valid claims because they want to win even if they owe the money under the law. They don't care, and they are happy to spread rumors to make it sound like the system is out of control. There are places in the world where there is no tort system and in those places might makes right. Having a system that allows people to sue each other to protect their rights is actually more economically efficient than living under a system where might makes right.

It is ridiculous. Someone climbed up onto my mum's patio roof to get into the garden to "borrow" my brother's bike (it was a friend of my brother and he and my brother were about 13 at the time). He had no permission to go into our garden, borrow the bike or be on the patio roof. However, our patio roof was not very sturdy, not designed for people to climb over funnily enough, and this lad fell through and ripped his new jeans open and but up his leg and was covered in cuts and bruises. My mum went to make sure he was okay and also to say to his parents that she didn't want a repeat because he got hurt and also because he shouldn't have been climbing over the patio roof anyway. My mum is not confrontationalin the slightest and so she wouldn't have been nasty about it, just told his parents what happened so he could be reprimanded as she would have done me or my brother if we were in the same situation. However, his dad then went mad at my mum and told her it was her fault and he was going to sue her. Luckily my mum got a really good solicitor and the county judge didn't award anything to the boy or his parents. In fact I think his words were "you were a very stupid little boy with very greedy, stupid parents".
It is absurd, though, that it even got to Court in the first place. Solicitors seem to have no soul whatsoever. If a doctor makes a genuine mistake then we have to accept that they are only human. If it's negligence then fair enough, sue them but all these claims because of human error or for greed are putting a huge strain on already struggling NHS.

Its part of the greed & blame culture where everything has to be someones fault, and its ok to make money whatever the means or consequences.
The problems don't get fixed or prevented, but people get the satisfaction of a good grudge, shouting match and victory. Its sad because we don't benefit from it, the cost of insurance goes up and theres less trust.
If someone was genuinely negligent and I got hurt, I'd sue. But not if I were a burglar that fell on a knife, tripped on a loose carpet or got bitten by the dog...

its not solicitors who make claims its their clients, little do you know that well over 70% of claims do not make it off the ground, there is a vexatious litigant list, where if you are on it, you need the courts permission to make a claim, don't believe the hype claims have been made for years and years, its just the media hyping it up!

Regrefully, we have our American cousins to thank for this ambulance chasing, claim culture society. It is only quite recently that this sort of claim has been aired but negligence is a different matter.
Anyone who puts life in danger by negligence should be answerable.

i understand and agree with what you're saying completely. everyone is human and makes errors in judgement...anyone who says they don't is full of crap.and we all do it almost everyday in one way or the other. accidents happen and misjudgements are made... so many people see it as the lottery when someone makes a mistake.
i could go on for hours about this, but i do know what you're saying...

It keeps the people who we put our trust in on their toes. While doctors don't go out of their way to make mistakes...they can be negligent.
