You are in a tough situation- I would consult a legal attorney in Family Law. Are you divorced? If you are, it would be illegal to take the child out of the state during the process. I agree with one of the viewers, that it would be nearly impossible to get him back if taken. Have you seen that movie "Not without my daughter". You should see it. I think it is done after a true story. It will give you some reference to cultures etc that may not fit your situation, however, you will get the point. Whatever, you do, you obviously have a mistrust for your husband. Be very careful of leaving your son alone with him.

Not if your son doesn't have a passport; customs won't let the kid leave the country.

If your son does have a passport, then your husband can get him out of the country. It's illegal for him to do so if you object and if you still have your parental rights, but customs won't know that unless you get a court order. So if you fear that your husband will try to flee the country with your son, it's time to get a lawyer.

Logistically speaking you sure can.... the *only* problem you may run into is the kid-knapping charges that would be issued against you. -and then that pesky Amber Alert might trip you up too... Why do want to leave so badly? are you in an abusive situation? If so, call the police... try to find out what legal routes you can take. Maybe ask one of your relatives from NJ to come & stay with you... I hope everything turns out.

As far as I know - no. Well, that's the situation in Ireland. Someone I know had to get her husband's permission to get a passport for their child to go on a holiday to Spain with her even though he knew the date they were going and when they'd be back. Get the advice of a solicitor who specialises in family law though.

The issue is not if he can do it or not. If he takes your child to another country without your consent, it may be very difficult if not impossible to get your son back home because of laws in his country and I'd be very careful if you fear him taking your son. Good luck.

if your son was born in Britian and is a British national them removing your son from his home country without your permission maybe seen as kidnap.
See a solicitor asap

No way. If you file complaint he can be charged with parental kidnapping, a federal offense. He can obtain the courts permission to do so if he cant get yours but has to have a realgood reason to do so.

to albania? was your son born in the country you are in now?then no. it's kidnapping. period. unless you give permission he can not take him out of his home country. at least it's like that in the u.s.
