We have a small house on five acres of land with a small barn and other out buildings. We rent it for $300.00 a month which is very reasonable I think. Our farming operation has expanded and we have hired help starting the first of April who will be living on the acreage.
I gave the renters notice the first of February we would need the place April first, giving them ample time I thought.
We have not received any rent for Feb or March and the $300.00 deposit I charged them when they moved in will not nearly cover the damages they've done.
What should we do?

When they were late the first month you should have gave them a 72 hour pay rent or quit the premises notice. Now they are 2 months late and likely will soon become 3, and 4 by the time you can evict them. Start the eviction process now and I hope you did a pre rental inspection so you can asses their damages. You will likely have to sue them to establish your damages claim. Get a judgement in your behalf and then you can legally open a collection process for recovery if they dont pay up. Be careful to follow the rules regarding evictions or you will be in violation of your states landlord tenant laws. It isnt fair to you but even in their situation they still have rights. Go to your states landlord tenant laws website and read up on eviction process. Or you can have a 3rd party eviction service handle it for you for their fee. Best of luck to you.

Every state is different. Go to your local courthouse and get a copy of your landlord tenant laws. Our courthouse has packets for the entire process including forms and step by step insructions. Also get the info for sueing them for the total losses. You probably won't ever get any money from them but a conviction should be pretty easy and it will be on their record.In our state (Alaska) the process is simple and if you are at all thourough with your paperwork, you would easily win an eviction.

Give him a 30 day notice. Mail one to the address give him a copy of it. While all this is in process, take them to court and the court will kick them out. It will be like a warrant. They will give them a date and time to move out. The Police will have a copy o f the court order. They will stop by the house on the date and time to make sure they are out. you might not get any money, you will have to pay for the court fees. I know this Sucks...

Find out the legal procedure for filing for eviction based upon non-payment of rent in your area and follow it to the letter.

Don't waste time on anything else.

Unfortunately the only option is magistrate court as allowed by your state's Landlord Tenant Act.
