Contact the labour board in your city or State.

It is illegal for the employer to not give you your last paycheque.

I was about 5 paychecks behind plus I was given hot checks around December 2005 - February 2006. I wrote several letters to my employer and she said she did not owe me anything. I finally filed through the labor board which they fought for me and found out so much information which they thought would help me out. They sent out warrants which I received copies of everything they sent out. After a few months nothing was done, so I filed with the small claims court. I had to pay for the court fees, not her. I actually won the case and she was told to pay. I then found out she was working in that same court and she still never paid me anything. After about a month I called the court and told them I still have not received any money and asked what else could I do. I was told to pay $16 and file for an abstract. This abstract was suppose to make it where she cannot sell any property or buy any major property within 10 years until my money was paid in full.

Finally, by November 2006 I received a check for $378.00. She still owes me much more, that wasn't even half of what she owes. I have not received any other mailings from either the labor board or the court and can do nothing else! I also, didn't receive my w2 and there is money missing even if I did.

I have recently found out that she sold her house and bought another and now has a new car. I paid atleast $150 more thinking I would get everything back.. but no! I still have plans to fight for my money and I will not stop.

First tell them you're going to the Wage and Labor board and attorney to report them. Usually this gets them to turn it over.

Contact your local labor and wage Office. Your employer cannot withhold your last paycheck for any reason. They must 1. give it to you upon your last employment date. 2. Give it to you no later than a 3 day period after your last scheduled day or firing - Or at regular payday whichever is closer. For each day of their holding your paycheck there is an interest payment rate that will or would be/could be paid to you on top of what your paycheck is. Labor board has that info. You must take your former employer to small claims court to collect it all (check, and interest incurred while being held) They lose and pay you back your court costs as well.

However they can withhold your check for a period of time in case you "owe" them money for advanced drafts. And when all that is cleared owe you the rest if anything.

You have to contact your State Employment and Labor Department and file a claim. An administrative hearing will then be set wherein you and the employer will tell your sides of the story. There will be an administrative judge who will then make a determination based on the facts they hear. Thus, be prepared with documented facts supporting your allegations, such as timesheets. Your word isn't good enough. Failure to provide documented evidence may result in your claim being denied.

Besides contacting the Labor Board near you, I would suggest finding out about laws regarding this, it benefits you greatly. For every day your employer refuses to pay your wages, penalties are added, and they will have to pay you more.

Call the labor board and find out, it is for your benefit.

call the labor board and report them they will investigate and make your employer pay you unless they are in the middle of bankrupcy

Small claims court. Send him a letter and tell him you will be filing a claim with small claims court. If he doesn't fork over the money, file a claim.

Take him to court and ask that the court award you your money (owed) as well as money for your mental anguish and trouble!

Break windows. Do enough damage to cover your pay cheque, and yes I'm Canadian so we spell it cheque.
