He has a job and is afraid of loosing his license for a yr. The law was changed in Jan 07 for minors with violations that involve alchohol. He has never been in trouble before and this has him terrified. I expect him to be punished, but I don't know what to expect.

A new drunk driving law that went into effect in January puts Tennessee on the map as one of the only states with a blanket “shaming law” on the books. Part of the new punishment for DUI includes three litter pick-up sessions while wearing a vest that says in bold letters, “I AM A DRUNK DRIVER.” You can still also lose your license for a year. The Governor’s DUI task force will release recommendations at the end of the month for a push to repeal the new shame law, and return to 48 hours of jail time and a one-year license suspension. Before the shame law, the DUI sentences in Tennessee were: 1st offense, a minimum of 48 hours in jail, a minimum of $350.00, and license is suspended for one year. The 2nd offense is a minimum of 45 days in jail, a minimum fine of $600.00, and license is suspended for two years. Also, your vehicle is subject to seizure. The 3rd offense is a minimum of 120 days in jail, a minimum of $1,100.00 fine and license is suspended for three years. The maximum punishment for any DUI conviction is 11 months and 29 days in jail, and a $10,000 fine. The state of Tennessee will take prior DUI convictions (as far back as ten years) into consideration when determining sentencing. The shame law only replaces the jail time. Usually when you lose your license, you are allowed to request a probationary license which give minimal driving privileges for the purpose of going to and from work. In order to negotiate the best possible terms for your son, an attorney is highly advised.
