I filed for child support from the biological father. Social Services closed my case because Im legally married. In the state of Virginia they say, because Im married my husband is the legal father of my son. Eventhough paternity test prove that he NOT. Is there any other way I can get my son biological father to pay child support?

Your husband is presumed to be the father, as he is your husband.

You have to establish paternity by opening a case with the Division of Child Support Enforcement. You will have to name the father.

Who did you name on the birth certificate?

You would need a paternity test proving that the biological father is who you say he is, then you would have to file a petition in court and have it determined by a judge. IF, you could prove the biological father was, indeed, the father, you most likely could get child support from him, but your word alone is not enough to force the biological father to submit to a dna test.
