Whose divorce? hers or yours? If you are under 18 you can't change your surname without your dad's agreement. If you start using another name while you're still a minor, your dad can seek an order from the court that your legal name be used, e.g. at school or college, and the school and college will have no choice but to obey the court's order. Once you are 18 you can change your name to anything you like and a Deed of Name Change is relatively cheap.
If you're thinking of changing your surname because of your parents' divorce, are you sure this is the right thing to do? If you're really so angry with your dad (and I don't know, maybe you have really good reason), can you talk to him?
If you do feel really strongly about changing your surname now, then you might be able to persuade your dad to agree, if you tell him calmly and quietly why you want to do this - of course this is if you ARE under 18. As I said, if you're 18 or over, it's simple and relatively cheap to get a Deed of Name Change drawn up by a solicitor. Although it's not strictly a legal requirement to have this to change your name, you will need it for the bank, DVLA and Passport Agency so it will make life so much easier for you.

Might sound a silly question, but why would you want to use your mums maiden name? Would you have a problem using your own maiden name?
You can call yourself any name you want but to do it legally ie for passport, driving license etc you will have to change your name by deed poll. I don't know how you go about this or the cost but see your solicitor who will help you.
Congratulations on your divorce....its a great feeling isn't it!

See your solicitor about a Change of Name Deed. This should cost around £60. You may even find you covered under legal help - if you were entitled to it in your divorce proceedings.

i have recently divorced i asked my solicitor the same question i was told i would have to change it by Dee poll which will cost £100 but a couple of friends that have got divorced just changed it them self they informed there bank and any one else that needed to be told i think it is against the law to do this but they have never been caught

Ring the CAB for advice and they will let you know all the routes you have to go down. Or you could ring the registry office and they should also be able to help you in this one. You can use any name you like but have to use your legal name on passports, bank accounts, driver licence.

Hun. Don't do that. Its your namesake. But if you must you have to file a petition through the courts. The judge orders it. Then you take those papers to the Vital Statics department in your area.

You file legal name change papers with the county courthouse. Look online for the forms. I would use Google to seach on legal name change and your state.
