i Was promised by my renter that they would pay some of their rent on march 16th. which is 500.00 the rent per month is 625.00 . I have not been contacted by my renters yet what do i do they owe me for water. the home is not paid for and i am having to make the payments and pay the insurance. they have two children and the husband makes money as a machinest. help please with any good advise.casehi2@yahoo.com

Find out what the procedure is for filing a complaint for non-payment is in your area. Some places require notice, others don't.

If you are in an area that doesn't require notice, then don't waste more time calling them, sending stupid letters and waiting around for your money. If they were on the up and up, they would have already contacted you and been candid about any delay.

In short, find out what the legal procedure is in your area and follow it to the letter. You don't need a lawyer or an expensive agency to handle a simple non-payment of rent filing. The forms are self-explanatory.

You can legally file an eviction warrant, however you must put something in writing prior to filing so you can make one last-ditch effort. After that's been resolved, the next time you have renters, make sure you hire a property management company so they can take care of the maintenance and the rent.

Send them a certified letter telling them exactly what they must do to remain in the house, and give them a deadline to remedy the problem. Also state in the letter that is rent is not paid by such and such a date you will be forced to turn the case over to an attorney.

what type of lease are they on? if mtm give month notice to end and find another tenant, if a fixed term lease then what does your lease say?

if they do not pay on time, do you have a late fee policy?

If they continue to pay late send a notice to cure, and if they do it again move for eviction

if they do not pay this month the full amount move for eviction

easy.go to any letting agency and ask for a copy of their standard letting agreement. have your tenant fill it out and add some penanty clauses of your own regarding late payments,interest,taxes,etc
tell them you will hand them over to the lawers if they fail to comply AND they will have to pay the legal costs
