Under Sec 375 of the Penal Code;

A man is said to commit “rape” who, except in the case hereinafter excepted, has sexual intercourse with a woman under circumstances falling under any of the 5 following descriptions:

(a) against her will;

(b) without her consent;

(c) with her consent, when her consent has been obtained by putting her in fear of death or hurt;

(d) with her consent, when the man knows that he is not her husband, and her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married or to whom she would consent;

(e) with or without her consent, when she is under 14 years of age.

So, a husband can still be charged under Rape under point (a) to (c).

certain it really is quite accessible and it does ensue. This being as there are people obtainable that do not realize that NO means NO. in case you flow compared and make it certain, then it really is RAPE. it doesn't count number that they are married or living at the same time. each people has the right to verify when we favor sex and this could be with a prepared spouse. or you are able to definitely see Mary and her 4 sisters. they could help you ANY TIME you want. Yes. It's called spousal sexual battery and if reported to the police, charges can be filed, just like any other sex related criminal offenses. No means no under any circumstances. Marriage does not give a man, free unlimited use of his wife's body for sexual gratification.

Yes there is such things about spouse forcing himself to his wife. If you said no to him but he ignores your plea,that is rape. My husband did that to me last year,after I told him no,please..but he ignores me and he did what he wants to do with me. He didn't spoke to me for at least a year even though that we live in the same roof.
So sweetie if you told him no,yes it is rape and you can press charge against him.......I'm sorry if this happened to you...

Yes. Sex should be a choice, and between two people when they are both willing. Just because two people are married doesn't mean they give up their right to have the choice to have sex or not.

Yes still means yes and no still means no even if you are married. The church doesn't think so, but people with brains do.
