I would like to purchase the property in an urban locality. The proposed land has a 24 sqft splay area. The seller claims that he is the owner for this area too and demands consideration for this piece too.

Do you mean play area. First if he owns it should be shown on his survey. He can claim anything he wants, but if he doesn't own it he can't sell it.

You can have a contingency clause in the contract, which you should anyways. Finalization of the contract should be contingant on you getting an acceptabel loan at reasonable interest rates, the home passing a professional home inspection, the home passing a RADON gas test. Also have this play area written into the contract, that if the play area doesn't show and convey to you then the contract would be voided.

The real bottom line though is really just this. Are you willing to pay the money he is asking, with or without the play area?
