can freely talk about the patient and the care, when sued for malpractice their is no doctor patient confidently nor under the privacy guideline for patient medical information

since the doctor has a Constitution right to defend himself against the suit and it's principal cause of action relating to the treatment

He'll be able to tell why the treatment given was appropriate and reasonable and why the person suing is at fault really because of failure to follow instructions.

But it won't matter that the Dr is right, the jury will see "rich doctor" (who has a gross income of $300k, but $190k in malpractice insurance and $50k in student loans to pay each year) and award the ungrateful scum, who's life was saved by the Dr... some obnoxious amount that drives the Dr into bankruptcy despite the insurance.

The normal doctor-patient privilege does not apply when the patient is suing the doctor for malpractice.
