This is not a freedom of speech issue. It is a question of how much authority the Executive has to dismiss judges without just cause.
This is a question that should have been asked years ago. The only precedent here seems to be that someone has ordered the dismissal of judges who were acceptable to Bush during his first term in order to replace them with other judges for purely political reasons, and that the Justice Department, which has a say (although not the final say) appears to have been instructed not by the President himself or his Chief of Staff, but by his chief political advisor.
Clinton did a spring clean when he first took office and fired all the judges, and he was not questioned because it is within his authority to do so. We probably should have.
The only questionable thing I see about the recent Bush administration firings is that these judges appeared to be OK for ultra-conservative Attorney General Ashcroft and for the President for years, then all of a sudden they are not good enough. It reeks of political payback - appointing people on the grounds that they contributed to Bush's re-election campaign, instead of on their records.
Gonzalez is trying to wash his hands of it, saying it was Harriet Mier's call, but personally, I can't see Miers doing this. She is much too straight-laced. More likely it was some kind of directive handed down by Karl Rove, and I ask you:
Who elected Karl Rove?
