That is, who uses office hours to slip out to smoke and boss is not aware of it?

I would suggest that if it does not directly affect you in your job, just let it go. Even though it does not seem fair that this person takes advantage of company time, you will probably be happier if you just focus on your own work and let the situation work itself out. However, if it does affect your work directly, I think management should handle it. Are you certain this person does not take a shorter lunch in order to compensate for extra breaks? Sometimes smokers borrow time off their lunches and breaks to allow for smoke breaks.

you should go out as well with them...use the time as a break and improve your productivity, have a quick meeting during the break, discuss issues and try to find creative solutions for problems, etc...if you don't smoke, you can have a coffee, tea or something similar!
