You need to use iTunes to place the music and videos onto the iPod correctly. I tried an experiment of directly copying mp3's to my pod and they wouldn't play correctly, so using iTunes software (free) seems required.
So about your question. You don't have to buy from apple. My music is from cd's, and other mp3's my girlfriend already had. They all play fine.

You need iTunes to download music to your iPod. You can import the mp3's you already have onto iTunes
