What's the criteria for getting one issued - husband is not violent but I need piece of mind that he can't just come back when ever and feel free to take whatever he feels like taking. He is a drug addict and sells things for money. i have 2 kids that are not his. Help- I need details i have know idea what my rights are in this situation. He has given up the house keys but still has clothes and stuff on the porch because of lack of a place to keep any of it.

Ask your local police. It' not the same everywhere. Where I live, you can't get one quickly or easily. You have to hire an attorney, summons the person to court and basically prove why you need one.

you dont need an order of protection. you need for him to get his stuff, take it to him if necessary. then, if he comes to the house, call the police. even if he has an ownership interest in the property, he cant come in when he wants to because he does not reside there, you do. and DONT put all of his stuff out on the porch. you sound like youre out of high school. be smarter and more mature than that. all throwing someones crap outside does is makes you look like a dramatic *** and feeds the fire. be peaceful and all around you will be as well. if you set an example like that for him, he is likely to retalliate your actions. this is how women get into abusive situations. smarten up.

Show your police reports and have a good justification. Get everything out of the house (store it outside) and then call the police, flash the protection order and when he shows up and have them force him to take everything away and stay away.

go to local police department tell them what you wrote here , they will give you one .
