now he gave his landlord lady a whole month deposit, with no lease signed or anything was just to hold. for april 1st. she took a check from us. so we contacted her today and told her we cant take the aprtment. she stated she is keeping the money, (which is govenorment money) so i put a stop payment on the check, since it was last month required by her, and she will charge the next new renter first and last . so she is making 2 last months rent off people... anyways i dont thin this is legal to keep that kind of money off people .. any one know the answer to this? was $700.00 deposit.. nothing signed as stated...

As long as you put a stop payment on the check in time, she won't get the money. If she does get the money somehow, you will need to probably contact a lawyer. Don't contact one of those tv lawyers as they are only in it for profit. Try to find a reputable lawyer, maybe someone you know or a friend knows. I think it is legal, as she held the apartment for him, even if it was only for one hour....it is possible that she could have lost another tenant during that time. That why landlords ask for deposits. Tenants leave a deposit to make an agreement that the landlord won't rent to another, even at a higher price!

Why do people not understand this concept??!!

It sounds like the rent was on a month-to-month basis and there is usually no contract on that basis. Although not nice, I think that she is entitled to keep the deposit is she can't rent the apartment by April 1st. If she rents it, then you should get your money back.

firstly, never put a deposit on something you dont intend to buy. second, never ever give someone money without a contract. i believe she could keep it because you backed out of a verbal contract. also, stopping payment on the check...she can take you to court for that too, and make you pay the check.
