I Paid $3500 for a fence. The company came and finshed most of the work but never completed some of the finishing work and never adjusted the gate. I keep getting excuses now like ill be there tomorrow ect. Now the gate just broke completly off because it was never adjusted right and opens with a little bit of wind. Should I threaten to take him to court I dont know if it is worth it. I also never got a final receipt from him gave me an excuse about that as well. I do have the cashed checks. any advice on how to handle this situation would be graetly appreciated.

If you have a contract indicating the amount of money for the job and a completion date and they have a license go to small claims court. Most of a job isn't a complete job. It will cost some for the filing but they may have to pay it and court costs. This will wake them up and it may get done before court. You do not need a lawyer. Call Magistrate

Take them to small claims court. Get an estimate from another fencing company on how much it would be to finish the work. Then sue them for that amount. If you have detailed notes, the judge will probably see it your way.

Hire another company to finish the job. Send that bill to the company that never finished the job. Or hire the second company to finish the job, then take the first company to court and sue them for the amount of the second company job.

Usually people used excuses as shield to their shortcomings. You have all your rights to obliged them to finish the jobs, court matter still unnecessary if they respond to your demand but two or three times enough. they ll feel free if u do nothing. push them until you satisfied of their service, thats what u paid for... good luck..

If they don't cooperate, get a lawyer. If anything, get the lawyer to write a letter stating if not completed, then action will be taken. Usually this will be a little scare into them and they will complete the process.

if you made a contract you can sue them for breech of contract....try and get proof of payment...threaten to take it too court...
