Depends on the situation. If they did nothing inappropriate than the fact that they were male in itself is in no way a violation of your rights.

That depends on the situation. You don't really give enough detail so that we can really answer your question adequately. For example, the only way there would be a cavity search is if you were already in custody and/or in a correctional facility. Possibly even if your were just visiting someone in a correctional facility. This is often the course of action for questionable visitors to prisons. If you refused to comply - either as the incarcerated individual or the questionable visitor, no. They can take all measures necessary to complete the task.

You didn't say if you were fighting, kicking or on drugs. In all instances, no way. The two male officers were trying to protect themselves, you and the person doing the cavity search.

You used the term "in body" cavity search. Is there such a thing as an out-of-body cavity search?

In most states only a female officer can do a cavity search on a female. This is not a matter of decency. Any other situation, such as the one you decribed, just opens the door to too many law suits.

Why would two officers have to hold you down? Were you fighting the search? If that is the case, then you have no reason to sue.

One. Why were there two officers doing this. Two. Look at your state rights. Go to any court house, or even call your lawyer and ask to look to "the books". Three. Gender has nothing to do with it sweetie.

You should contact a lawyer -- but you should be able to sue the local dept. and the officers who did it. If they were forceful and you asked for a female officer and they didn't comply then you were sexually harrassed in my opinion -- I wouldn't go as far as the state though.

If you are a female they should have had another female officer do the search. I would speak to a lawyer if I were you.

Sue for what ? You'll just make more trouble for yourself. I'd drop the matter.
