No, she can't stay. Under no circumstances can she stay. She MUST go back before the date her stay expires.
You can sponsor her for a K-3 visa. It will take 6 months to a year before she's issued the visa, assuming she's found eligible.
No, she can't come back again as a tourist while she's waiting for the K-3.
You don't need a lawyer. The forms are simple and straight forward. A lawyer cannot make the process go faster. It's all based on the date the petition is filed. Millions have gone through the process without a lawyer, why waste $2,500?

If she is already here in the US, there's no need for her to go back if the two of you do get married. Her visa would be useless once she get's her permanent residency (green card) in a few months after getting married. Getting married is not breaking any laws. You do have to file application right away. All the paperwork is on the website www.uscis.gov along with instructions. You don't have to hire a lawyer. I know someone who hired a lawyer and it didn't help their case. I never had a lawyer but everything went smoothly. It takes roughly 5 months to get it approved and she becomes a permanent resident right away which means she can work and travel abroad etc. During that period of waiting is the only time she can't work or travel abroad.

Yes you can get married, no she can't stay.
With a tourist visa she has to go back no matter what. The worse thing she could is over stay her visa, then there would be a good chance you can't get her back in even if you married her.
Find an immigration attorney and go in for a single visit. He will tell you every thing you need to do and you don't even have to hire him...yet.

You can marry her in the US and that would be legal. However, marrying her in the US while she is on a visitor's visa would actually set back your plans for her to acquire permanent residency in the US. I know it doesn't make sense but it is easier for a foreign woman to join you in the US permanently if she comes over on a K-series (fiancee) visa. In other words, once you get married while she is still on a visitor's visa--she won't qualify for a K visa. Regardless, seek the advice of a good lawyer. This can get vey tricky very fast legally.

yes u can get married .... i think she can stay if u file the proper paperwork but u need to talk to an immigration lawyer ... its usually done with a fiance visa ....

yes you can, but she still have to go home when her visa expired and you have to petition her for spousal visa.
if you marry her and she won't go home when her tourist visa expired, and the Immigration find out about it she will be deported and won't be able to come back.
i know a relative of my friend who did the same thing. they got married her visa expired she can't get any necessary papers to work here, she wasn't able to do anything. the immigration send her back home and barred from coming back here.

And YES you can file for a petition for her while she's there. No need to come back here.
You can either hire a lawyer (additional expense) or just do it yourself (usvisa.com).
