Hi.. I rented out my duplex to person with 3 dogs and when he moved in he stated that his dog r well behaved and that he would pick up their poop. 4 months later he has not kept up his agrment. nor has he paid me a deposit and is constantly late with his rent. i let him go on first 2 rent pmts being late even though my lease states $50.00 late fee.. he is up all night wakes up my kids, lets dogs run all around upstairs and after I put in new carpets.. and one of his dogs I know pees and poops on the carpet. Therefore they are not well trained at all. I am fed up.. evicting in a week,.. evicting him in a week, I let him know that he needs to move out at end of that week. He is claiming to sue.. can he?? even though he has no reciepts of pymt on rent?? Is constantly late with rent, has not paid deposit either, stays up all night, and doesn't clean up after his dogs??

The criteria necessary for a successful eviction vary from state to state. I would suggest that you enlist the help of an attorney with respect to your issue. In my particular area, evictions are not overly complex, but I AM aware that some states place much heavier restrictions and requirements on landlords. As a note to the future, develop yourself a proper written lease for tenants. If you legally denote all your requirements of a tenant, it is much easier to prove that they violated your requirements.
