My sister's ex is a lazy useless deadbeat. He won't work and he won't help support his own children. He went to jail a month or so ago for being so far behind on his child support. . When he gets out of jail what will happen if he still won't pay? Will they put him back in jail?

thats a crock of crap (the other poster, and i am ignoring the pig who posted above me as well). JAIL has PROVEN effective for most cases; the states have collected MILLIONS of dollars from deadbeats with our new laws.

you need to give your sister some info:

1) call your caseworker and ask:
--where you apply for interest on the arrears?
--was the case submitted for tax refund intercept?
--was the arrears reported to the credit reporting agencies yet?

2) sit down and write a letter. in it, give your contact info, case number, his info, arrears amount, the problem and ask them what they are doing about it.

ask them why there are not leins on his bank accounts, drivers license taken away, thrown in jail more often, forced to sell his property, etc.

then take that ONE letter and FAX it to the following:
a) your states Attorney General (link is below)
b) your states Governor (link is below)
c) your states Regional FEDERAL Child Support Office (link is below)

phone calls are useless; they are ignored, denied and forgotten. mail ends up on someones "to do" pile, but FAXES are effective. its proof you sent it and proof they recieved it, therefor, they HAVE to address it. if you cant find a fax number (most are listed online) then just call them and ask for it.

if you hear nothing in a week, fax them again. fax them weekly if need be. its the squeaky wheel that gets the oil, if ya know what i mean.

who cares if you miff 'em off, just keep at them... every week.

3) post his DEADBEAT FACE ON A DEADBEAT SITE ONLINE.

He will be given time to get a job. If he continues to refuse to pay child support he can be placed back in jail. Depending on the judge and the state he can stay in jail regularly. Some places have work release where he is working and paying toward his child support. He should have to pay a percentage of back child support.

The answer to your question will vary from state to state.

But regardless of how much "jailing" occurs, this will not help the situation. Child support needs to be paid. Someone in jail can't pay. A lazy person like the one you describe should be monitored closely, and whenever he obtains any money or assets, they should be seized for payment of child support.

Forget the jailing. All that does is wreck any job he may have had, and cost the taxpayers lots of money.

Jailing deadbeat dads is a poorly thought out programme which is not really working.

Yup. My father was in and out of jail a few times a year when I was growing up. He'd pay enough to get out, then get behind, my mom would call the court, they'd put him back in, and so on and so on.

Funny thing - they picked him up the day AFTER my wedding (I got married a wee bit to young the first time!) and he tried to say the money he gave me as wedding present ($50!) constituted a payment.

I'd tell your sister that she better be finding away to support herself and her children. You can send this guy to prison as often as you like and the first thing you do is terminate any real income that he might have had. And I'm thinking that if he really is a lazy deadbeat, he will never have much of a job, so give it up and try to make a life without him.

I'm not sure but in the state where I live, he can be put in jail three times and if he still doesn't pay, he gets off scott free.

It sucks but the law is lazy too.

I don't know about where you live, but our county will issue a felony civil contempt warrant for him and set his bail at what he is in arrears for, in cash. They will continue to do this as many times as needed.
