The evidence should be fairly easy to come up with. All they have to do is check the IP address the e-mail was logged into at a known time and trace it to ISP, and possibly the individual computer. But that can only be obtained by law enforcement from the e-mail host.

One way to know is have the husb get a friend to hack his wife's computers email.....(they are an ex couple now)...the man that hacked was fined $5,000 for his actions.....that was how the law handled that type situation.
