Recently the builder and majority shareholder of our Manhattan condo mailed us a letter stating that, as an employee, our nanny must enter the building through the back entrace and that we would be fined $500 every time she used the front entrance. This was not in the bylaws when we purchased the unit. Is this legal?

Bylaws can be amended.

Just because it wasn't in the bylaws when you bought the unit doesn't mean it isn't in there now.

Bylaws are laws or rules governing the internal affairs of an organization. In this case your condo association is the organization. If your condo association has elected to implement this, then it is "legal" as it is a law of the association. Bylaws just can't be contrary to public policy.

Since there is no law in NYC that says domestic employees must use the front entrance, your association can make that a "law" in your building.

If you don't like it, you can either try and get it changed or try and get yourself elected to the board.

Most contractors and delivery people have to enter via the back entrance, usually because of equipment they are carrying.

For domestics, that does not sound legal.

Send them a letter back and ask them why. Also, if it's not in the bylaws of the condo (which you vote on), you do not have to abide.

No, this isnt legal.
I would be mailing copies of this letter to the state attorneys office, the governor, the mayor of your city and a discrimination attorney real fast. I would even send a copy of it to the newspapers.
Do not let them get away with this. Continue as you have been and let them fine you. Each time, I would send copies of the fines to the above places.
It burns me up when someone tells me what I can and cant do in my life.
