i had my car written off by a foreign lorry, it is going through my insurance (tescos) however they have rung me to say i never told them about a sp30 conviction i had on my license (speeding camera ) ive just bought myself a new car and am panicking they wont pay me out as i cant afford to pay for two finances for two cars.
i had been told under FSA regulations they should send me at time of renewal a form to sign and send back but i never get this just a form saying they have renewed my policy and here are my details.
has this happened to anyone before?? what was outcome??
do you know if this form should be sent everytime??

They may pay you. If they do then it will be less the amount you saved by not informing them of the conviction, in addition to any penalty they may apply. They are however, within their legal rights to not pay out at all on the basis that the information you gave them changed, and you failed to inform them. It is actually an offence in its own right not inform your insurance company of such a change!

You have obviously had your insurance renewed since you got the points.Yes they often just send a new policy without signing an application again but I believe you find in the small print the renewal is on condition that there has been no change in circumstances,if there has been then they will likely not pay up you've broken the rules and the law so why should they let their shareholders down by paying out their money

It's your responsibility to tell them of any changes to your eligibility for insurance, in your case, your speeding conviction. You don't wait for them to send you a form at renewal date. You must tell them as soon as you are convicted. So you will probably find that Tesco will surcharge you for the period since your conviction, which they will deduct from the pay out from the wrecked car.
I hope you have told your new insurers that you have a motoring conviction.

I think they can if they really wanted to. I know of somebody who didn't get a payout because their tyres were bald and not road legal. I would be very surprised if they did not pay out because of a speeding fine.

Why don't you offer to pay what would have been the extra premium had you mentioned it and see if they concede?

You are up sh!t creek without a paddle. when you get insurance you sign to say that you will tell them if your circumstances change. Your circumstances changed and you didnt tell them. Tough.

And it did happen to me, I had a brand new car (3 months old) I didnt tell them about points and they wouldnt pay out.

As with a most insurance: you are fully covered...right up to the point you make a claim. You have had it I afraid.

I hate insurance companies... if they can get out of paying money out they will... But dont panic yet

non of us can tell you the actual answer... Why dont you just ask them if they are going to pay out?
