The landlord has basically done nothing to put a stop to it other than suggeting we all have a meeting, (yeah like want to talk it out with an apparently unstable person after she threaten to kill me) I have had to get the cops involved a few times becuase she was banging on my door and ringing my bell like a lunatic screaming she's gonna put bullets in my door and kick my *** and kill my baby (i'm almost 4 mos. preg mind you) ... I've told the landlord that I am looking to move becuase I do not feel safe there for my baby. She said that she will give me my security back if i give her 30 days notice... I may have found and apt for the 1st and still want my security... the apt i'm in now is in the same condition i moved in and there is no damage. Does she have a right to keep my security if i am out before 30 days and there is no damage to the apt? i live in New York have lived there for a year and do not have a lease.

If you have had to call the cops, they have records of those calls, document them. There should be a date and time, a report or incident number, badge numbers of the officers that responded, and their written report of the situation they found. I don't know what it would cost in NY to get copies of the reports, but at the very least, you need to have the number of those reports/incidents.

If you haven't already, IMMEDIATELY write a letter to your landlord, and reference the conversation you had; if you EVER mentioned at all to your landlord that you were having problems with this neighbor, reference that conversation, too. When did the landlord suggest having a meeting? You need to be proactive here, and mention that you truly want to cooperate but are afraid that this person may come armed to any meeting, since she has been threatening to shoot you and your main concern is the safety of your unborn child. Use the report dates as evidence of your fears for your safety. The biggie here is documentation, and it's good that you've had to call the cops. Be civil, be cool, be professional in the letter.

Take Polaroid pictures of the apartment to prove your claim that there is no damage to the apartment, as that is directly what the deposit is for.

With the copy of the letter and the polaroids and the police report numbers, there should be a board you can go to that oversees landlords and rentals there (check the yellow pages or a local womens group), there should also be a free legal service for this kind of problem - and they will love to see you, if you have all this documentation (again, check the yellow pages). There are resources for help out there, especially if you are female and on your own with a kid (expecting should count)

I've been through this kind of thing in Colorado, and that's what worked for me.

If you have documentation of these events with your neighbor with the police, I think you can get your deposit back. You could take it to small claims court and when you show up for court make sure to have a copy of all the police reports before you go. Just tell the judge what happened and what your landlord said and show him the paperwork. If it really came down to it, you could even have them supeina (< OOPS, spelled it wrong) your neighbor to court, but try to avoid that if you can. // If you have already paid this months rent you could offer to pay for how ever many days it would take to cover the balance of the thirty days notice and see if your landlord would go for that, that is if you can afford to pay out the extra money. So you would rather sit around and not tell anyone about his behavior and potentially harm your mom and unborn baby because you are scared?? Grow up and get a backbone!!! You tell your mother right now! Then you both go to the police and tell them what he is saying and has done to you in the past! Don't be a victim, honey! Be strong for your baby and your family. If you don't tell anyone you run the risk of him harming you, the baby, and your mom. What if something happened to your mom because you were too scared to do soemthing about it?? How would you feel? Guilty? You sure would be! Start taking care of yourself and do whatever necessary to keep this guy away from you and your family. Doing nothing makes you a victim... and you put yourself as the victim. Stand up, and be strong.

You can go to court to get your security back if you have proof that you moved for yours and your childs safety. Do you have anything in writing that you notified the landlord? This will help your case.

If you didnt sign a 30 day notice move out, she has no right to keep your deposit. As for the @$$HOLE neighbor, its against the law to threaten anyone with violence, including fetuses, so you should press charges on her @$$. Record her & call the law!
