lets say you are driving in the left lane, someone comes up to your right and moves over into your lane just barely missiing hitting the right side of your car and did not signal or warn you (they didnt hit you but could have if you hadnt braked) lets say you were driving at normal speed and his actions caused you to hit him. who would be at fault here?

i was driving the other morning on my way to work and a guy dipped right infront of me with no warning. i quickly hit my horn and slowed down but he was so close we could have collided. i was pissed the whole way to work. how dare he do that to me. i guess me going the speed limit ticked him off.

Would been his fault and the it would left tire tracks from slideing your car to side when hitting it making it apparent who was in lane and who was passing by the scraps on vehicle and whatever it would torn off it would gone in direction of the vehicle that hit you

If you're driving in any lane, and somebody just moves in ad hits you on the side- obviously its their fault for not paying attention (legally, though, there's "no fault states", where it'd be different- but the ball would be in your court anyway in that case). HOWEVER... what you're describing seems to be different. Even if you're doing the speed limit in the left lane, not passing anybody, or going slower than the general traffic- you're in the wrong. In a lot of states- that's illegal (albeit hardly enforced). Remember- Slower Traffic Keep Right, whatever the sircumstances. Let the cops catch speeders. (here in Michigan it's safe to say 90% drive above speed limit) If you hold them up- all it does is it makes them pised off and they do something stupid, like swerve around you, and across multiple lanes...
