Ok, first off this question is not regarding me, its just something i was curious about. I have no kids, i have no child support. So dont come back with the name calling and saying im trying to get out of paying.
My question is this: if a man owes X-amount of backpay in child support, lets just say $5,000 to put a number on this. He owes this money from like when the kid was 16-17-he didnt pay. And the kid in question is grown up now - age is like 23-thus he is an adult and no longer in his mothers custody. (Keep that part in mind)
Now, lets say the father decides to come clean and pay what he owes. Does this money go to the kid (who is now an adult) or does it go to the mother? Remember, the mother no longer is the guardian of the child, since the kid is now an adult.

I personally think it should go to the kid but legally it may go to the mother since it was hardship on her to pay for the child since the father didn't.

Well, it depends on the state said person lives in. In Ohio, the mother would get the money. My aunt still recieves it, her kids are grown and her ex is still paying back child support, because he was just a deadbeat to begin with. And when you file your taxes it can be taken to pay such things.

Back child support is owed to the same person it was originally owed to. The mother.

Back pay goes to the mother. She supported him in the years where no child support was received, so she is the one to receive the money.

gone are the days of hiding til the child is 18; today, arrears are forever. you see, the courts are onto this little trick.

not only that, but the interest of the amount can also be tacked on, as well as cost of living increases over the years (every 2-4 years depending upon the state).

doesnt matter if that child is 30 and getting married, the arrears are still owed the parent who solely provided for that child for all of those years....

put it on the credit reports, leins on bank accounts, taking drivers license and more.

to the mother, that's who child support is paid to; the parent with custody to help pay for the child's necessities

Im not really sure how that would work but my guess is it would go to the mom cause she was the one paying for the child in the time the dad wasnt so they probably pay her back so to speak

Talk to your local court house clerk, they may be able to help steer you in the right direction. Every county has different policies.....you need to follow the policies set forth by the judge in the county the ruling was made.

I bet the B itch gets the money. That whole child support garbage AND the fact the parent has the kids. Seems a little out of wack. It comes down to her being a paid baby sitter to her own kid. Most the time all she wants is the money and the old man out of her life! There aught to be a law agaisnt such woman.
