My question is about Illinois Child Support. Now me and my fiance is getting married next year but I receive some papers saying they about to start taken money from my job because of support. I've always been there for my child and me and my fiance live together. She haven't filed a claim on me or anything. How come they can just come at me like this. And why? Should I seek legal advice?

My husband and I just got married because of the same issue in Ohio. We got pregnant with our son right after he switched jobs, so health insurance wasnt available to him so I received assistance and as soon as he was born they sent him paperwork to the house we live at together and he provides for us. I dont work, I stay at home with our son so we just got married earlier than we had planned and everything was settled. I dont think its fair to those fathers who are providing for thier children and have the Child Support Agency go after them. It shows on their credit report as a debt until they are through paying childsupport. Totally unfair for the good men out there.

Sounds to me like the mother filed papers for support, they can "come at you" like that because she filed and every legal guardian of a child has the right to try to pusue child support. Unfortunately for you, it does not matter in the eyes of the legal system, how much you support your child. But if I were you, I would contact your local child support enforcement center and make sure that however much they will be deducting from your pay is the right amount. They can legally only take out a certain percent of your pay, and if you have not gone to court personally and proved your wages, they could be taking more or less than what they are legally allowed. I am not sure if it is the same in Ill. as in Mich. however; I do know that if you and her had a child (which ya'll obviously did) and at anytime she recieved medical assistance, food stamps, or anyother type of state assistance.... they will go after the other parent. I don't think it is right, but I honestly feel they are just looking out for ya'll baby. You could try getting some assistance through legal aide, (if you don't make " too much money") and they might be able to steer in you down the right path
I am personally going through a lot with my ex and a child support issue here in Mich. Good luck to ya'll. Just stay encouraged.

It sounds to me like she has been getting public assistance. So the government will take you to court for child-support if they see you as not paying to support your child. Like a medical card or food benefits. I would suggest you talk to your fiance and tell her to get off of public assistance. If you need the money from the government to survive, this might just be something you have to put up with.

It sounds like someone has filed some papers, find out who. I dont believe they will come after you unless someone files. Is it possible that there is someone else out there who could have had your baby and did not tell you about it?

she must have filed for some sort of state assistance; welfare, rental assistance, etc. you see, the states dont take kindly to taking care of other peoples children today, and they have passed laws to make sure that they dont.

i think you should tell them at court that you both live together, are getting married.... and support her/the child now.

unless you dont, then thats another matter... then you will now, thats for sure.
