If you are Indian & married according to Hindu marriage ceremonies & rites i.e. under the Hindu Marriage Act,1955 you both can apply for Divorce by mutual consent as provided in section 13-B of this Act : -(1) Subject to the provisions of this Act a petition for dissolution of marriage by a decree of divorce may be presented to the District Court by both the parties to a marriage together, whether such marriage was solemnized before or after the commencement of the Marriage Laws (Amendment) Act, 1976, on the ground that they have been living separately for a period of one year or more, that they have not been able to live together and that they have mutually agreed that the marriage should be dissolved.

(2) On the motion of both the parties made earlier than six months after the date of the presentation of the petition referred to in sub-section (1) and not later than eighteen months after the said date, if the petition is not withdrawn in the mean time, the Court shall, on being satisfied, after hearing the parties and after making such inquiry as it thinks fit, that a marriage has been solemnized and that the averments in the petition are true, pass a decree of divorce declaring the marriage to be dissolved with effect from the date of the decree.

Think over it. Both of you agreed for something called divorce, That means both of you have a level of understanding where you both agree for certain action called divorce,, am i right, well why dont you expand this a little more so that you will find alternate for this thing called divorce. even without divorce you can agree for more things in life go ahead and enjoy life as it comes you are not God nor the destiny maker, you are a walker on a road the road is rough you cant stop walking you have to reach the destiny

In such a case they can go for a mutual divorce which is relatively hassle free and takes considerably less time than if only one partner applied for divorce. Consulting a lawyer is a necessary requirement.

cheapest way is to go to your public library to the information counter and ask for "non-contested" divorce papers. It will cost you less than 3 bucks to get the papers...instructions included.
fill them out, call the courthouse and find out how much it cost to file...usually under 200
...so for less than 300 you have a divorce if you both agree on everything. You don't even have to go to the hearing if you sign the waiver paper.

Instead of divorce you can file for dissolution of marriage. Its a no fault divorce.

You can easily buy forms at your local OfficeMax and Staples store. Once signed and agreed to, then you'll need to take them to your local courthouse.
