We were leaving the money for our milkman in our empty bottles on the step over night. Our milkman said he never received the though though. I thought it might had been moles or badgers stealing it so i set up a camera to find out. Anyway it turns out it was the milkman taking the money all along!

To get him back i dug a 5ft hole in our path and disguised it so he would fall in it, which he did. He broke his leg though and is now trying to sue me. has he got a leg to stand on?

Only one, at the moment... but when the other leg gets better he could try to milk you for all the money you've got!

Sadly, he has a case against you under the Occupiers Liability Act, as he is an invitee on your property -- i.e. a person with a legitimate reason for entering with your permission, probably express permission (was it Express Dairies, by any chance?), as the arrangement was for him to leave the milk on the doorstep.

I say sadly, as I suffered from the theftuous activities of a milkman years back, when he milkman insisted on calling for his money at 6am on a Saturday morning to induce people to leave the money out for him. Money kept going missing. In the end we cancelled the delivery. You can, after all, freeze milk.

We also had a milk thief and a neighbour who was disposed to get up early lay in wait for him and beat him up. Very gratifying!

The milkman was on your land as a implied guest and as such you owe him a duty of care under the Occupiers Liability ACT 1957.

Your defiantly going to get sued.

lol! no he totally had that one comming :P! Legaly though, you should have just showed the videotape of him stealing the money to the police. Digging a hole is kind of taking the law in your own hands. But that was seriously funny XP!

leaving aside the pun of 'yes, the one thats not broken' yes he has. Under the occupiers liability act you have a duty of care to anybody on your premises (this even includes burglars) and if he has fallen down a hole on your property its highly likely that he will get a settlement from you. If youve not got liability insurance this is going to be expensive....

He has a broken leg to stand on. You shouldn't have done that...I'm surprised you haven't been charged with a crime for that stunt. Yes, he can sue and will probably win...better notify your insurance carrier.

You could claim that the hole was dug by moles or badgers. Unless he filmed you digging it.
